II.9.9 Burden on Agencies
Criticism: The new FOIA review obligations to be placed on the agencies will be extremely burdensome and will overly constrain already thin agency budgets.
Response:
Agencies have FOIA offices in place, staffed with full time employees who are trained in proper procedures for responding to FOIA requests. The degree to which these offices will experience additional burdens as a result of the new data access law is unclear. More funding can be provided to these offices, however, in the event that such appropriations are needed. An anticipated need to adjust agency staffing levels should not be permitted to defeat sound and important public policy.
